1. Services and scope

Genuine Strength provides remote fitness programming, exercise education, progress review, and coaching communication for the offer identified at enrollment. The exact service, schedule, price, renewal terms, and start date are the terms displayed or otherwise confirmed before payment.

2. Client responsibilities

The client agrees to provide accurate information about training history, relevant health conditions, symptoms, medications, injuries, equipment, and schedule. The client remains responsible for choosing a safe training environment, using equipment correctly, following instructions, communicating concerns promptly, and stopping exercise when unusual pain, dizziness, shortness of breath, or another concerning symptom occurs.

3. Fitness coaching is not medical care

Coaching is educational fitness guidance. It is not medical diagnosis, treatment, physical therapy, mental health care, or individualized medical nutrition therapy. The client should obtain medical clearance when appropriate and should direct medical questions, injuries, and symptoms to a qualified healthcare professional.

4. Voluntary participation and exercise risk

Exercise and athletic training involve foreseeable and unforeseeable risks, including soreness, strains, sprains, falls, equipment failure, aggravation of an existing condition, serious injury, illness, and in rare cases death. The client chooses to participate voluntarily, may ask questions before signing, and may decline or stop an exercise. Nothing in this agreement waives a right that cannot lawfully be waived.

5. Fees, recurring billing, and payment

The client agrees to the price and billing frequency shown for the selected coaching offer before checkout. A recurring offer renews at the stated interval until cancelled in accordance with this agreement and applicable law. One-time services do not renew. Card information is handled by ABC Trainerize and Stripe, not stored by this website.

6. Cancellation and refunds

The client may submit a cancellation through the website cancellation page or by emailing the address listed in this agreement. New York cancellation rights and any additional offer-specific cancellation or refund terms remain available and are not waived. Refunds, when required, will be handled within the period required by applicable law.

7. Communication and third-party services

Coaching may be delivered through ABC Trainerize, email, video calls, and other agreed communication methods. The client is responsible for maintaining access to the email address and account used for coaching. Third-party services are also governed by their own privacy and service terms.

8. Privacy and agreement records

Genuine Strength may retain the client's name, email address, selected service, agreement version, exact agreement text, signature time, receipt identifier, and limited device or request metadata needed to document the transaction, protect the record, respond to disputes, and meet legal obligations. Payment card data is not collected by this website.

9. Training materials

Programming, written resources, videos, and other coaching materials are licensed to the client for personal use. They may not be sold, published, shared publicly, or distributed to another person without written permission.

10. No guarantee of results

Training outcomes depend on many factors outside the coach's control, including consistency, effort, recovery, health, nutrition, sleep, and individual response. Genuine Strength does not promise a particular result, performance level, body-composition change, or timeline.

11. Governing law and complete agreement

New York law governs this agreement to the extent permitted by law. The agreement, the selected offer details, and any required written notices make up the complete agreement for the coaching service. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted. Statutory consumer rights cannot be waived by this agreement.

New York cancellation notices

CONSUMERS RIGHT TO CANCELLATION. YOU MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN THREE (3) BUSINESS DAYS FROM THIS DATE. THE CONTRACT DATE IS THE ELECTRONIC SIGNATURE DATE SHOWN ON YOUR SIGNED RECEIPT. Notice of cancellation shall be in writing subscribed by the buyer and mailed by United States mail or electronic mail to the seller at the address or email address specified in this agreement. Such notice shall be accompanied by the contract forms, membership cards, and any other documents or evidence of membership previously delivered to the buyer. All moneys paid pursuant to this contract shall be refunded within ten business days of receipt of the notice of cancellation. If the buyer has executed any credit or loan agreement to pay for all or part of the services, any negotiable instrument executed by the buyer shall also be returned within ten business days.

ADDITIONAL RIGHTS TO CANCELLATION: You may also cancel this contract for any of the following reasons: If, upon a doctor's order, you cannot physically receive the services because of significant physical disability for a period in excess of three months. If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing. If you move your residence more than twenty-five miles from any health club operated by the seller. If the services cease to be offered as stated in the contract.

Electronic records and signatures

Electronic signing is voluntary. Your consent applies to this coaching agreement, its receipt, and related records provided electronically during the coaching relationship. You may withdraw consent for future electronic records, update your email address, request a paper copy, or arrange to sign on paper by contacting the seller. There is no added fee for a paper copy. Withdrawal does not affect an agreement or record already signed. To access and retain electronic records, you need an internet-connected device, a current web browser, access to your email address, and the ability to save or print a web page or PDF. Viewing and signing this page demonstrates that you can access the electronic format used.

Electronic signing is voluntary. You may request a paper copy or arrange to sign on paper without an added fee by contacting Genuine Strength before enrollment. Contact: coach@genuinestrengthlab.com.

Agreement acknowledgement

I have reviewed this entire agreement, had the opportunity to ask questions, and agree to be bound by its terms for the coaching service identified above.
